Shipping Policy
This Shipping Policy applies to all orders shipped or delivered by or on behalf of Web Restaurant Equipment.
By placing an order that requires shipping or freight transportation, the customer agrees to the terms below.
1. Shipping and Delivery Timeframes
All shipping, freight, transit, and delivery dates provided by Web Restaurant Equipment are estimates only unless a guaranteed delivery service is specifically purchased and confirmed in writing.
Estimated delivery times may change due to circumstances outside the control of Web Restaurant Equipment, including:

Freight carrier delays

Manufacturer delays
-
Weather
-
Traffic
-
Road closures
-
Mechanical breakdowns
-
Labor shortages
-
Supply chain disruptions
-
Terminal delays
-
Appointment scheduling

Government action

Natural disasters

Other circumstances beyond our reasonable control
Web Restaurant Equipment is not responsible for losses, penalties, lost sales, lost profits, food loss, labor costs, business interruption, or other damages resulting from carrier or transit delays.
2. Freight Carrier Responsibility
Once merchandise has been released to the freight carrier, transportation and handling are performed by the carrier.
To the fullest extent permitted by law, Web Restaurant Equipment is not responsible for damage caused while merchandise is in the possession of a third-party freight carrier.
Freight shipments may be covered by the carrier's liability coverage, cargo insurance, or other applicable transportation coverage according to the carrier's terms.
Damage claims are subject to the rules, limitations, deadlines, and claim procedures of the applicable carrier or insurer.
3. Customer Inspection Required at Delivery
The customer must inspect the shipment before signing the delivery receipt.
Before accepting delivery, the customer should inspect:

Crates
-
Pallets
-
Shrink wrap
-
Straps
-
Equipment
-
Packaging
-
Visible exterior surfaces
Any visible damage, shortage, missing item, torn packaging, crushed packaging, broken crate, or other irregularity must be clearly written on the carrier's delivery receipt before the customer signs.
The customer should also take photographs of:

The entire shipment
-
Damaged packaging
-
Damaged equipment
-
Shipping labels
-
The delivery receipt
4. Signing Without Damage Notation
If the customer signs the delivery receipt without noting visible damage or shortages, the shipment may be considered received in apparent good condition by the carrier.
Failure to properly document visible freight damage may reduce or eliminate the carrier's responsibility for the claim.
Web Restaurant Equipment is not responsible for a carrier's denial of a claim caused by the customer's failure to inspect or document the shipment at delivery.
5. Severely Damaged Shipments
If a shipment arrives with severe visible damage, the customer should contact Web Restaurant Equipment immediately before refusing the shipment whenever reasonably possible.
A shipment should not automatically be refused for minor cosmetic damage without first contacting Web Restaurant Equipment, because refusal may create additional freight, storage, or redelivery charges.
6. Concealed Damage
Concealed damage is damage that is not visible until the merchandise is unpacked.
The customer must inspect and unpack the equipment promptly after delivery.
Any concealed damage should be reported to Web Restaurant Equipment and the freight carrier as soon as possible.
Customers must retain all original packaging, crates, pallets, and shipping materials until the freight claim has been resolved.
Carrier deadlines for concealed damage claims may be limited, and failure to report damage promptly may result in denial of the claim.
7. Freight Claims
When freight damage occurs, Web Restaurant Equipment may assist the customer with documentation and the claim process when appropriate.
However, the final determination, approval, denial, valuation, repair authorization, replacement, or reimbursement of a freight claim is made by the freight carrier or applicable insurer.
Web Restaurant Equipment does not guarantee the approval or payment of any freight claim.
8. Freight Damage Is Not an Automatic Refund
Freight damage does not automatically entitle the customer to cancel an order or receive a full refund from Web Restaurant Equipment.
Depending on the circumstances and the carrier's claim determination, resolution may include:

Repair
-
Replacement parts
-
Equipment replacement
-
Freight claim reimbursement
-
Other reasonable resolution
The appropriate remedy will depend on the nature and extent of the damage and the applicable carrier or insurance coverage.
9. Shipping Charges
Shipping, freight, fuel surcharges, liftgate charges, residential delivery charges, inside-delivery charges, appointment fees, redelivery fees, detention charges, storage charges, and other carrier charges are generally non-refundable once incurred.
If a customer provides incorrect delivery information or is unavailable for a scheduled delivery, any additional carrier charges may be billed to the customer.
10. Delivery Access
The customer is responsible for ensuring that the delivery location can safely accommodate the shipment.
The customer must disclose in advance if the delivery requires:

Liftgate service
-
Residential delivery
-
Limited-access delivery
-
Inside delivery
-
Appointment delivery
-
Construction-site delivery
-
Military-base delivery
-
School or government facility delivery
-
Special equipment or handling
Additional charges may apply.
11. Curbside and Standard Freight Delivery
Unless specifically stated otherwise in writing, standard freight delivery is generally to the carrier's normal delivery point and does not include installation, uncrating, assembly, inside placement, stair carries, rigging, utility connection, or removal of existing equipment.
The customer is responsible for moving the equipment from the delivery point to its final location unless additional services were purchased.
12. Customer-Arranged Freight
If the customer arranges their own freight carrier, shipping company, pickup service, broker, or transportation provider, Web Restaurant Equipment's responsibility ends when the merchandise is released to the customer's designated carrier, to the fullest extent permitted by law.
Any damage, loss, delay, or claim occurring after pickup must be addressed directly with the customer's transportation provider.
13. Incorrect Address or Failed Delivery
The customer is responsible for providing a complete and accurate delivery address, contact name, and telephone number.
Additional charges resulting from an incorrect address, failed delivery, reconsignment, redelivery, storage, or customer unavailability are the customer's responsibility.
14. Shipping to Commercial Locations
Commercial restaurant equipment is frequently shipped by freight carrier.
Customers should ensure that someone authorized to inspect and sign for the shipment is available at the delivery location.
The person receiving the shipment is responsible for documenting visible damage or shortages before signing.
15. Risk and Responsibility
Risk associated with transportation by third-party carriers is subject to applicable law, the carrier's bill of lading, insurance coverage, shipping terms, and any written agreement between the parties.
Nothing in this policy is intended to waive rights or obligations that cannot legally be waived.
16. Limitation of Liability
To the fullest extent permitted by law, Web Restaurant Equipment will not be liable for indirect, incidental, special, consequential, or commercial losses arising from:

Carrier delays

Freight damage
-
Missed delivery dates
-
Business interruption
-
Lost revenue
-
Lost profits
-
Spoiled food
-
Labor costs

Installation delays

Project delays
Web Restaurant Equipment's responsibility, if any, will be limited according to the applicable transaction documents and applicable law.
